Cold Plunge Tub Draw Terms and Conditions

By participating in the draw, participants agree to be bound by the following terms and conditions.

1. Organizer.
   The draw is organized by BuenoSpa.com (“Organizer”), which is a subsidiary of Wellis Magyarország Zrt. The Organizer’s principal place of business is 7850 NW 32nd Street, Unit C, Doral, Florida 33122, USA.
   
   
2. Eligibility
   

   NO PURCHASE OF ANY PRODUCT OR SERVICE IS NECESSARY to win the Prize (as defined below), and a purchase will not improve the chances of winning. The draw is open to the United States residents ages eighteen (18) and older residing in the conterminous United States only. The draw is void outside of the conterminous Unites States. Employees, agents, and affiliates of BuenoSpa.com, Wellis Magyarország Zrt., and Wellis USA, Inc., and their immediate family members are not eligible to participate in the draw.

3. Prize
   The prize is one (1) Alaska Cold Plunge Tub manufactured by BuenoSpa.com and valued at $4,995 (“Prize”). Cash will not be awarded instead of the Prize. The Organizer is not responsible for taxes associated with the Prize, which must be paid by the Prize winner. The odds of winning the Prize depend on the number of entries, which the Organizer estimates to be approximately ___________. 
   
   
4. Entry

   All entries must be postmarked by June 26, 2024, and received by July 1, 2024, to be eligible for the draw. Entry is limited to one (1) per household.

5. Draw Date and Selection Process
   

   The draw will take place on July 31, 2024. The winner will be selected at random using a computerized selection program.

6. Winner Notification
   The winner will be notified by email within five (5) business days following the draw. The winner must respond to the winning email notification within sixty (60) days of being notified of winning. For the name of the winner, BuenoSpa.com may be contacted at 7850 NW 32nd Street Unit C, Doral, Florida 33122.
   
   
7. Prize Delivery
   Curbside delivery will be arranged by BuenoSpa.com within ninety (90) days after the winner’s acceptance of the Prize and will be at BuenoSpa.com’s expense. Shipping of the Prize is only available within the conterminous United States. BuenoSpa.com is not responsible for any shipping delays caused by forces outside of its control.
   
   
8. Forfeiture
   Should the winner fail to claim the Prize within sixty (60) days of the Organizer’s email notification, the winner will forfeit the Prize. In such event of forfeiture, BuenoSpa.com reserves the right to select an alternative winner.
   
   
9. Publicity
   By accepting the Prize, the winner consents to use by BuenoSpa.com of his or her name and likeness for promotional and marketing purposes without additional compensation.
   
   
10. Privacy
    Personal information collected from participants will be used in accordance with BuenoSpa.com's privacy policy (which can be found on its website at BuenoSpa.com) and will only be used for the purposes of administering the draw and notifying the winner.
    
    
11. General Conditions
    Buenospa.com reserves the right to cancel, suspend, or modify the draw if any fraud, technical failures, or any other factor beyond Buenospa.com's reasonable control impairs the integrity or proper functioning of the draw, as determined by Buenospa.com in its sole discretion.
    Buenospa.com reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of the draw or to be acting in violation of these terms and conditions.
    All decisions made by Buenospa.com regarding the draw are final and binding.
    
    
12. Draw Integrity
    BuenoSpa.com reserves the right to cancel, suspend, or modify the draw if any fraud, technical failure, or any other factor beyond BuenoSpa.com's reasonable control impairs the integrity or proper functioning of the draw, as determined by BuenoSpa.com in its sole discretion. BuenoSpa.com reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of the draw, or to be acting in violation of these terms and conditions. All decisions made by BuenoSpa.com regarding the draw and the award of the Prize are final and binding.
    
    
13. Governing Law
    

    These terms and conditions are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles.

14. Limitation of Liability
    

    BuenoSpa.com is not responsible for any incorrect or inaccurate information submitted by participants, whether caused by the participants, tampering, hacking, or by any equipment or program associated with or utilized in the draw. Further, BuenoSpa.com is not responsible for any errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication line failure, theft or destruction, or unauthorized access to its website in the process of its notification of the winner.

15. Tax Implications
    The winner is solely responsible for any taxes, fees, or other costs associated with the receipt and use of the Prize. It is recommended that the winner seek independent tax advice regarding the winner’s tax liability with respect to the Prize.
